How to state terms and conditions?

When purchasing something online, some websites make you click a box that says you have read and agree to the terms and condition, others just say that by purchasing you agree to our terms and conditions (no box to click just state the terms and conditions on the purchase page). Do both serve the exact same purpose? Is the second option just as effective as the first?
